In terms of enforcement, we find the French National Prosecutor seems fairly driven to prosecute companies, less so individuals. Currently, there are hardly any convictions of individuals as a result of CJIP proceedings.

Victoire Chatelin and Juliette Vandest share a European Account Preservation Order

In an effort to facilitate and engage in cross-border asset recovery dialogue, Victoire Chatelin and Juliette Vandest share a European Account Preservation Order, obtained in accordance with Regulation (EU) n°655/2014, aimed to facilitate recovery efforts.

• EAPO’s are an effective and underutilized tool by practitioners and courts.

• The method authorizes issuance of a protective attachment order on a debtor’s bank accounts held in another Member State under the condition that the creditor establishes urgency to attain a protective measure. While our case included contested arguments, our ruling was ultimately confirmed. Thus, clarifying proper applicability in France.
